“Gray Rape” in Cosmopolitan Magazine

An article titled, “A New Kind of Date Rape” in the September issue of Cosmopolitan magazine, refers to gray rape, a term the author describes as referring to “sex that falls somewhere between consent and denial and is even more confusing than date rape because often both parties feel unsure of who wanted what.” Popularizing a victim-blaming concept such as “gray rape” is bad enough, but even more appalling are the stories used to illustrate the idea. The article talks about one woman who went on a date with a man, made out with him and clearly told him that she did not want to have sex. He said OK, but raped her anyway. When he penetrated her, she told him, “No, stop.” Another anecdote featured in the story talks about a woman who kissed her date and told him she needed to leave. He pinned her to the bed and raped her.

What, in either of these examples, can possibly be construed as “gray”? Cosmo seems to be reverting to the archaic view that “true” rape only occurs in cases where the perpetrator threatens the victim with a weapon.
